A foundation is a legal entity that is endowed with assets in accordance with the realization of a goal, usually charitable.
An entity, called a founder, decides to detach a portion of its assets-so-called asset separation-and create an entity with its own organization, variously structured.
It is possible to create a foundation during one's lifetime or with a will, perhaps naming the entity after oneself: this is a fairly frequent way by which one ensures that, after one's death, one's resources will be used, in whole or in part, for purposes deemed worthy by the founder.
Where the purposes fall within some specific areas, it will also be possible to apply for recognition as a non-profit organization.
This allows for a number of significant tax benefits, both at the time of incorporation and during the actual life of the entity.
Specific procedures must be followed for both the establishment of the entity and, if applicable, the assumption of NPO status.
